Areas of activity

1) within the competence of the General Directorate, the development (participation in the development) of activities of national and federal programs of the Russian Federation, draft international treaties of the Russian Federation, decisions of the Eurasian Economic Commission (hereinafter referred to as the EEC), regulations of the President of the Russian Federation, the Government of the Russian Federation, federal laws, regulations of the Ministry of Finance of the Russian Federation, regulations of the Federal Customs Service of Russia, including interdepartmental regulations, in the fields of activity of the General Directorate;

2) operational monitoring and analysis of customs operations, results of customs control and other types of public control entrusted to the customs authorities of the Russian Federation (hereinafter referred to as the Customs Authorities), in order to ensure the generation of operational information on the indicators of customs operations and customs control, risk assessment, including fiscal and non-fiscal risks, determining measures to minimize risks and the application procedure thereof, as well as customs control on matters falling within the competence of the General Directorate;

3) assessment of the Customs Authorities' performance in the fields of activity of the General Directorate with the use of performance and efficiency indicators, which characterize, among other things, the use of a risk management system (hereinafter, the RMS) and customs control of the customs value of goods;

4) identification of trends in the emergence of threats and risk situations in the trade of the Russian Federation with the EAEU member states and third countries;

5) dentification of breaches of Russian international treaties regulating customs legal relations, acts constituting the EAEU law, and the legislation of the Russian Federation on customs regulation, negative trends and risk situations in the course of customs operations;

6) preparation of draft management decisions and instructions of the Head of the Federal Customs Service of Russia to the heads of Customs Authorities and structural units of the Federal Customs Service of Russia based on the results of operational monitoring and analysis of customs operations;

7) information and analytical support of activities of FCS of Russia structural units and the leadership of the FCS of Russia in the fields of activity of the General Directorate;

8) arrangement and performance of operational duty service in the FCS of Russia and arrangement thereof in the Customs Authorities;

9) ensuring that the RMS application and customs control of the customs value of goods is duly regulated by law;

10) arrangement, coordination and control of activities of the Customs Authorities as regards the RMS application and customs control of the customs value of goods;

11) ensuring that risks of breaches of international treaties of the Russian Federation regulating customs legal relations, acts constituting the EAEU law, and the legislation of the Russian Federation on customs regulation, including fiscal and non-fiscal risks, are minimized by developing (updating) and applying appropriate risk profiles and risk analysis techniques;

12) development and improvement of categories of persons performing customs operations.

Functions

1) exercises control and supervision over compliance with the international treaties of the Russian Federation regulating customs legal relations, acts constituting the EAEU law, the legislation of the Russian Federation on customs regulation, as well as regulatory and other legal acts adopted pursuant thereto in the fields of activity of the General Directorate;

2) ensures that the Customs Authorities apply international treaties of the Russian Federation regulating customs legal relations, acts constituting the EAEU law, the legislation of the Russian Federation on customs regulation, as well as (in the part referred to the scope of activity of the FCS of Russia), other legislation of the Russian Federation in the fields of activity of the General Directorate in a uniform manner;

3) prepares proposals to the Head of the FCS of Russia on improving the international treaties of the Russian Federation regulating customs legal relations, acts constituting the EAEU law, the legislation of the Russian Federation on customs regulation, regulations of the Ministry of Finance of the Russian Federation, regulatory and other legal acts of the FCS of Russia within the competence of the General Directorate;

4) participates in the activities provided for by national and federal projects (programs), as well as priority programs and projects in the main fields of strategic development of the Russian Federation that fall within the competence of the General Directorate;

5) participates in the monitoring of legislative and other legal acts of the Russian Federation and law enforcement practice, analysis of annual addresses of the President of the Russian Federation, state social & economic development programs and other program documents of the President and the Government of the Russian Federation as concerns the activities of the General Directorate;

6) performs operational monitoring and analysis of customs operations, results of customs control and other types of state control entrusted to the Customs Authorities;

7) within the competence of the General Directorate, takes measures to promptly respond to risk situations identified during the ongoing monitoring and analysis of customs operations;

8) prepares draft management decisions and instructions of the Head of the Federal Customs Service of Russia to the heads of Customs Authorities and/or structural units of the Federal Customs Service of Russia:

  • to eliminate breaches and deficiencies identified as a result of monitoring and analysis of customs operations;
  • to eliminate breaches, counter negative trends and risk situations in the course of customs operations, as well as to counter threats and risk situations in the trade of the Russian Federation with the EAEU member states and third countries;
  • to improve approaches to the arrangement of the activities of the Customs Authorities in the performance of customs operations and customs control on matters falling within the competence of the General Directorate;
  • to analyze customs operations and results of customs control by regions of activity of the Customs Authorities and/or fields of control;

9) prepares information, analytical and statistical materials for the leadership of the FCS of Russia and structural units of the FCS of Russia on matters falling within the competence of the General Directorate:

  • on the performance of the FCS of Russia in the main fields of activity of the Customs Authorities for a certain period;
  • on the main results of the work of customs posts (electronic declaration centers) for a certain period;
  • on the performance of customs operations in electronic customs offices, customs posts (electronic declaration centers), customs and customs posts of actual control, regional customs directorates, on the results of customs control and other types of state control entrusted to the Customs Authorities, for a certain period;

10) prepares information and analytical materials and reports for the leadership of the FCS of Russia:

  • on the performance of customs operations, the results of customs control and other types of state control entrusted to the Customs Authorities, identified violations and negative trends, measures taken to eliminate violations and counteract negative trends, results thereof;
  • on trends in the emergence of threats and risk situations in the trade of the Russian Federation with the EAEU member states and third countries, the redistribution of the scope of customs declaration of goods between the EAEU member states, between the Customs Authorities;
  • on issues identified during functional inspections conducted by the General Directorate and proposals for the solution;
  • on issues of customs operations and customs control and proposals for the solution;
  • on medium and long-term process development forecasts of customs operations and customs control;
  • on measures taken by the Customs Authorities and structural units of the FCS of Russia in accordance with the decisions and instructions of the leadership of the FCS of Russia to counteract the identified violations and negative trends, as well as to improve approaches to the arrangement of the activities of the Customs Authorities in customs operations and customs control;

11) by decision of the Head of the FCS of Russia, exercises control over the actions of customs officials when performing customs operations on matters falling within the competence of the General Directorate, including through the presence of officials of the General Directorate at the places of customs operations and in the customs control zones;

12) by decision of the Head of the FCS of Russia, arranges and conducts targeted inspections of the activities of structural units of Customs Authorities as regards the control of the customs value of goods and RMS application, functional checks of activities of structural units of Customs Authorities in accordance with the assigned competence;

13) participates in inspections of the activities of customs authorities and official inspections of the FCS of Russia on matters falling within the competence of the General Directorate;

14) prepares (participates in the preparation of) documents (acts, certificates, orders of the FCS of Russia) based on the results of inspections and functional checks;

15) defines the tactics of the RMS use by the Customs Authorities, the procedure for collecting and processing information, conducting risk analysis and assessment, developing and implementing risk management measures, as well as the procedure for the use of information contained in the approved risk profiles by the Customs Authorities;

16) defines risk areas, including fiscal and non-fiscal risks, in respect of which regional customs directorates and customs offices necessarily approve risk profiles and apply risk mitigation measures;

17) develops the types, form and structure of risk profiles, risk analysis techniques, proposals for updating or canceling risk profiles, as well as other documents developed and used by the Customs Authorities for the purpose of applying the RMS, including the procedure for filling the same out;

18) arranges, coordinates and controls the activities of the Customs Authorities and structural units of the FCS of Russia as regards the RMS application and improvement;

19) determines the measures to be applied by the Customs Authorities on the basis of risk assessment;

20) implements the risk management process, including the risk mitigation measures provided for by the identified risk profiles, as well as the risk mitigation measures that may be applied without the risk profile;

21) controls how the Customs Authorities apply the risk mitigation measures provided for by the identified risk profiles, as well as the risk mitigation measures that may be applied without the risk profile;

22) ensures that the officials of the General Directorate are present when applying risks mitigation measures in cases where such instruction is provided for by the identified risk profile;

23) analyzes and controls the efficiency of the application (non-application) of risk mitigation measures provided for by risk profiles, as well as the risk mitigation measures that may be applied without a risk profile, by customs officials;

24) reviews, coordinates and approves proposals of the Customs Authorities, structural units of the FCS of Russia on updating and canceling risk profiles, risk analysis techniques and communicates the same to the Customs Authorities;

25) develops, updates, approves and cancels risk profiles, risk analysis techniques and communicates the same to the Customs Authorities;

26) ensures that the Customs Authorities carry out risk management functions in a uniform manner, analyzes the efficiency and takes measures to improve the performance of the Customs Authorities in risk management;

27) ensures the development and improvement of the scientific and methodological base of risk management, inter alia, taking into account the standards of the World Customs Organization and risk management standards applicable in the Russian Federation;

28) coordinates the implementation of a set of measures to create, implement and apply a promising RMS model in the Customs Authorities based on the consignment automated risk assessment technology;

29) ensures the application of a subject-oriented approach within the RMS in order to apply differentiated measures to mitigate risks;

30) participates in the development of the following regulations determining:

  • the procedure for customs control of the customs value of goods exported from the Russian Federation;
  • the procedure for deferred determination of the customs value of goods exported from the Russian Federation;
  • the procedure for categorizing persons performing customs operations, frequency and forms thereof, the criteria characterizing the activities of persons performing customs operations and methods to assess the same, the conditions for classifying these persons as low, medium or high risk, conditions for the differentiated application of risk mitigation measures to them;
  • the procedure for holding consultations between a customs authority and a declarant in order to make a reasonable choice of the cost basis to determine the customs value of goods imported to the Russian Federation corresponding to Articles 41 and 42 of the Customs Code of the Eurasian Economic Union;
  • the procedure for making and issuing a preliminary decision on the application of methods for determining the customs value of goods imported into the Russian Federation;
  • cases of customs control of the customs value of goods by specialized (functional) units of Customs Authorities, responsible for customs value;

31) develops the procedure for monitoring compliance with the criteria and conditions for classification as low-risk by persons performing customs operations classified as low-risk;

32) categorizes persons performing customs operations;

33) monitors compliance with the criteria and conditions for classification as low-risk by persons performing customs operations classified as low-risk;

34) arranges and coordinates the maintenance of an “Electronic File” of a foreign economic activity participant of the central register of subjects of foreign economic activity as part of the Unified Automated Information System of Customs Authorities;

35) analyzes the use of inspection facilities (hereinafter, the IFs) in Customs Authorities, prepares proposals for the improvement of the IF system and participates in activities for the improvement of the IF system;

36) performs activities pertaining to the unification of approaches to the RMS application by the Customs Authorities of the EAEU member states and the development of unified RMS standards within the EAEU;

37) submits proposals to the EEC to identify risk areas, including fiscal and non-fiscal risks, in respect of which the customs authorities of the EAEU member states are recommended to develop risk profiles and apply measures to mitigate the risks;

38) performs functions of the secretariat of the working group under the Joint Board of Customs Services of the member states of the Customs Union on the RMS development in the Customs Authorities of the EAEU member states;

39) develops regulations defining the procedure for actions of customs officials during customs control of the customs value of goods imported into the Russian Federation or exported from the Russian Federation, including the procedure for actions of customs officials when the information stated in the customs declaration changes in connection with a change in the customs value;

40) develops regulations determining the form, format and structure of the electronic declaration of customs value and the procedure for filling it in with respect to goods exported from the Russian Federation, prior to the approval of such a form, format and structure by the Eurasian Economic Commission;

41) carries out customs control of the customs value of goods transported across the customs border of the EAEU through territorial customs authorities and in cooperation with representative offices (representatives) of the Customs Service of the Russian Federation in foreign countries, other federal executive authorities, executive authorities of constituent entities of the Russian Federation, the Central Bank of the Russian Federation, public associations and other organizations;

42) arranges, coordinates and controls the activities of the Customs Authorities in the customs control of the customs value of goods transported across the customs border of the EAEU when imported into the Russian Federation and exported from the Russian Federation;

43) interacts with manufacturers of goods, specialized associations, unions, and analytical agencies in order to obtain reliable information necessary for risk assessment and to improve the efficiency of customs control;

44) collects, systematizes and analyzes price information, inter alia, in cooperation with interested federal executive authorities, foreign economic activity participants, as well as relevant industry associations and unions;

45) conducts price research in relation to goods that are the subject of economic and foreign economic activity;

46) participates in the preparation of proposals for the purchase of catalogs, reference books and paid information resources in order to obtain up-to-date price information and its use in the arrangement of customs control of the customs value of goods;

47) makes a preliminary decision on the application of methods for determining the customs value of goods imported into the Russian Federation, at the request of the interested person;

48) participates within the competence of the General Directorate in the consideration of complaints against decisions, actions (omissions) of the Customs Authorities and their officials, acts of prosecutorial response;

49) participates, within the competence of the General Directorate, in customs control of the customs value of goods after the release of goods in the form of customs inspections and other forms of customs control determined by the international treaties of the Russian Federation regulating customs legal relations, acts constituting the EAEU law, the legislation of the Russian Federation on customs regulation, and control over decisions taken based on the results of customs control;

50) conducts departmental control of decisions, actions (omissions) of the Customs Authorities within the competence of the General Directorate;

51) prepares draft decisions based on the results of departmental control within the competence of the General Directorate;

52) administers information and software tools (hereinafter referred to as ISTs) that ensure the RMS functioning and customs control of the customs value of goods;

53) provides identification of facts of incorrect work (errors) of ISTs administered by the General Directorate;

54) participates in resolving issues of IST creation, implementation, operation, development and/or maintenance, development of information and communication technologies that ensure the implementation of the functions of Customs Authorities in the fields of activity of the General Directorate;

55) ensures, in terms of the competence of the General Directorate, that the measures aimed at ensuring compliance with information security requirements are duly implemented;

56) ensures that the officials of the General Directorate carrying the operational duty service in the FCS of Russia;

57) arranges the activities of the structural units of Customs Authorities entrusted with the functions of carrying out the operational duty service;

58) carries out continuous collection, generalization, and analysis of data received from customs authorities and institutions under the jurisdiction of the FCS of Russia on the operational situation, incidents, extraordinary and emergency situations;

59) provides the leadership of the FCS of Russia with information on the results of operational duty activities of operational units of Customs Authorities;

60) participates in cooperation with the customs services of foreign states on the prompt exchange of information on possible customs offenses;

61) with respect to matters falling within the competence of the General Directorate, communicates the instructions and orders of the leadership of the FCS of Russia to the Customs Authorities, structural units of the FCS of Russia and monitors the execution of such instructions and orders;

62) notifies the leadership of the FCS of Russia and customs authorities upon receipt of the relevant signals from federal executive authorities;

63) receives and registers reports of offences in the FCS of Russia, reports received via the hotline of the FCS of Russia, notifications sent by officials of structural units of the FCS of Russia to the Head of the FCS of Russia about the facts of any persons contacting them in order to induce them to commit corruption offenses;

64) develops methods for calculating performance and efficiency indicators, indicators of Customs Authorities on the RMS application, customs control of the customs value of goods and other activities of the General Directorate;

65) monitors the implementation of the approved indicators of the effectiveness and efficiency of the Customs Authorities on the RMS application, customs control of the customs value of goods and other activities of the General Directorate;

66) prepares opinions on the implementation by the Customs Authorities of the approved indicators of the effectiveness and efficiency of the RMS application, customs control of the customs value of goods and other activities of the General Directorate;

67) develops forms of statistical reporting of Customs Authorities in the fields of activity of the General Directorate;

68) collects, summarizes and analyzes statistical reports of Customs Authorities in the fields of activity of the General Directorate;

69) analyzes information on best practices and developments in the field of organization and execution of customs operations, customs control in order to prepare proposals for the implementation thereof in Customs Authorities;

70) participates in the development of proposals to improve customs regulation in the Russian Federation;

71) participates in the development of measures to simplify and facilitate customs operations and customs control;

72) participates in the preparation of proposals to the Head of the FCS of Russia on improving the forms and methods of customs operations and customs control;

73) participates in the preparation of proposals for automating the process of customs operations;

74) prepares proposals for the formation of information used to ensure the functioning of information systems of the Customs Authorities;

75) participates in the consideration of innovative projects in the field of organization and execution of customs operations and customs control;

76) conducts analysis of law enforcement and judicial practice in the field of the General Directorate’s activities on matters falling within the competence of the General Directorate, and prepares proposals for the improvement thereof;

77) participates in the preparation of proposals to the Head of the FCS of Russia on determining the competence of Customs Authorities to perform customs operations in respect of goods transported by air, sea (river) transport, goods sent across the customs border of the EAEU in international mail; goods intended for display at exhibitions, fairs, international meetings and other similar events, as well as cultural values and monitoring compliance with the approved competence of the Customs Authorities;

78) prepares proposals to the Head of the FCS of Russia on the distribution of powers between the Customs Authorities, their structural units and officials on the RMS implementation;

79) ensures the confidentiality of information within the competence of the General Directorate during customs control, as well as the protection of information constituting state, banking, tax and other secrets protected by law;

80) interacts in accordance with the approved procedure with authorized representatives of the President of the Russian Federation in federal districts, international organizations, federal executive authorities and organizations, as well as citizens on matters falling within the competence of the General Directorate;

81) participates in the activities of commissions, councils and working groups, as well as in meetings on matters falling within the competence of the General Directorate;

82) provides explanations to legal entities and individuals on matters falling within the competence of the General Directorate;

83) participates in representing the interests of the Federal Customs Service of Russia and other Customs Authorities in courts when considering cases in the field of activities of the General Directorate;

84) provides methodological assistance to Customs Authorities on matters falling within the competence of the General Directorate;

85) considers proposals of structural units of the FCS of Russia, Customs Authorities and institutions under the jurisdiction of the FCS of Russia on the activities of the General Directorate;

86) considers, within the competence of the General Directorate, the appeals of federal executive authorities, organizations and citizens in accordance with the procedure approved by the legislation of the Russian Federation;

87) participates in the analysis and consideration of the technical capabilities of product samples for the identification (determination of quantitative and qualitative indicators) of goods offered for procurement for the needs of customs authorities;

88) participates in the consideration and coordination of annual applications of the Customs Authorities for information and technical equipment;

89) develops (participates in the development of) model regulations on structural units of regional customs directorates, customs offices, customs posts in the fields of activity of the General Directorate, participates in the development of general and individual regulations on regional customs directorates, customs offices and customs posts;

90) participates in the organization and provision of professional development of state civil servants, additional vocational education of employees of the General Directorate and Customs Authorities;

91) participates in the coordination of additional professional programs intended for study at the Russian Customs Academy
(its branches);

92) participates in the preparation of proposals for determining the personnel policy of structural units of Customs Authorities in the fields of activity of the General Directorate.
